1. Acceptance of terms

By accessing newup.tech you agree to these Terms of Service. If you do not agree, please do not use the site.

2. Permitted use

This is an institutional site. You may:

• Freely access public information (product descriptions, pricing, cases, FAQs).
• Request commercial contact via forms (Schedule demo, Talk to sales, WhatsApp).
• Test the conversational agent within configured limits (rate-limit of 1 call per number every 5 minutes).

3. Prohibited use

You agree not to:

• Use automated bots, non-standard crawlers, or scrapers to collect site content.
• Reverse-engineer the NewCob agent or attempt to replicate its models.
• Bypass rate-limit, captcha, or any other anti-abuse control.
• Use "Test Our Agent" to send spam, harassment, or any unlawful communication.
• Access internal areas (admin, dashboards, APIs) without explicit authorization.

4. Intellectual property

The brand, logo, design, written content, source code, and AI models are owned by NewUp Tecnologia LTDA. Commercial use, redistribution, or creation of derivative works requires written authorization. You may cite short excerpts with clear attribution for journalistic, academic, or review purposes.

5. Limitation of liability

The site and test agent are provided "as is". We are not liable for:

• Occasional site or service unavailability (maintenance, provider outages).
• Third-party content accessed via external links or integrations (LinkedIn, Cal.com, WhatsApp).
• Business decisions made based on site information without direct consultation with our team.

The contractual relationship with operational customers is governed by a specific MSA (Master Service Agreement), separate from these institutional terms.

6. Privacy

The processing of your data is governed by the Privacy Policy. By using the site you agree to the terms described there.

7. Changes to these terms

We reserve the right to change these terms at any time. Significant changes will be highlighted at the top of the page for 30 days after publication. Continued use of the site after the notice period constitutes acceptance of the changes.

8. Jurisdiction
